1. Introduction

Welcome to Planet Positive Ride, a digital platform designed to facilitate communication between event participants for the purpose of organizing shared transportation.

The application is owned and operated by Toleranca Marketing d.o.o. (“Company”, “we”, “us”, or “our”).

By accessing or using the application, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you should not use the application.

2. Purpose of the Application

Planet Positive Ride enables users to:

• Connect with other event participants
• Communicate and coordinate shared transportation arrangements
• Calculate carbon emissions

The application acts solely as a communication platform and does not provide transportation services.

3. User Responsibility

By using the application, you acknowledge and agree that:

• You are solely responsible for your interactions with other users
• Any agreements, arrangements, or decisions made with other users are at your own risk
• You will exercise reasonable judgment and caution when communicating and arranging shared rides

4. No Liability for Off-Platform Activities

The Company is not responsible or liable for:

• Any agreements made between users outside or inside the application
• Any transportation arrangements or services provided by users
• Accidents, injuries, damages, or losses occurring during shared rides
• Cancellations, delays, or changes in agreed transportation
• Misconduct, misrepresentation, or behavior of any user

All such activities are undertaken entirely at the users’ own risk.

5. No Verification of Users

The Company does not:

• Verify the identity of users
• Perform background checks
• Guarantee the accuracy of user-provided information

Users are responsible for evaluating whom they choose to interact with.

6. Acceptable Use

Users agree not to:

• Use the application for unlawful purposes
• Share false, misleading, or harmful information
• Harass, abuse, or harm other users
• Use the platform for commercial transport services unless explicitly permitted

We reserve the right to suspend or terminate access for violations.

7. Data Protection and Privacy

Toleranca Marketing d.o.o. and partner JT Digital d.o.o. are committed to protecting user data.

• Personal data is collected and processed solely for the purpose of operating the application
• Data will not be used for unrelated purposes without consent
• Data handling complies with applicable data protection laws, including GDPR

8. Pricing and Payment Policy

The fixed fee for using Planet Positive Ride is €350 per event, excluding VAT. VAT at the applicable rate of 22% will be added where applicable.

The fee is payable by the event organiser or contracting organisation for each event registered on the platform.

9. Intellectual Property

All content, branding, and technology related to Planet Positive Ride are the property of Toleranca Marketing d.o.o. and partner JT Digital d.o.o.

Users may not:

• Copy, modify, or distribute any part of the application
• Use branding without prior written consent

10. Availability of Service

We do not guarantee:

• Continuous or uninterrupted availability
• Error-free operation

We may modify, suspend, or discontinue the application at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or opportunities
• Personal injury or property damage arising from user interactions

12. Indemnification

Users agree to indemnify and hold harmless Toleranca Marketing d.o.o. from any claims, damages, or liabilities arising from:

• Their use of the application
• Their interactions with other users
• Their violation of these Terms

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Slovenia.

Any disputes shall fall under the jurisdiction of the competent courts in Slovenia.

14. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the application constitutes acceptance of any changes.
